House Passes Sweeping Bans on Gender-Affirming Care for Minors with Support of 46 Virginia LGBTQIA+ Organizations.
In a week marked by intense ideological division, the U.S. House of Representatives on Wednesday approved two major pieces of legislation aimed at prohibiting and criminalizing gender-affirming medical care for minors. The votes represent the first time such national bans have cleared a chamber of Congress, signaling a significant escalation in the federal battle over LGBTQ+ rights.
The House moved forward with two distinct but complementary bills during the final session before the holiday break:

H.R. 3492 – The "Protect Children’s Innocence Act: Sponsored by Rep. Marjorie Taylor Greene (R-Ga.), this bill passed on Wednesday with a 216-211 vote. It seeks to make the provision of gender-affirming care—including puberty blockers, hormone therapy, and surgeries—a federal felony for anyone under 18. Medical providers could face up to 10 years in prison and substantial fines.

H.R. 498 – The "Do No Harm in Medicaid Act: Sponsored by Rep. Dan Crenshaw (R-Tx.), this bill passed on Thursday. It specifically targets federal funding by prohibiting Medicaid coverage for gender-affirming procedures for minors nationwide.
The votes largely followed party lines, though they were notable for a small number of crossovers. Three Democrats voted in favor of the criminalization bill, while four Republicans voted against it, citing concerns over federal overreach into medical practice.
Proponents of the legislation argue that these measures are necessary to protect children from irreversible medical procedures. During floor debates, Rep. Greene characterized the treatments as "mutilation," stating that minors lack the developmental maturity to consent to such life-altering care.
Conversely, the medical community and civil rights advocates have condemned the bills. Organizations including the American Medical Association (AMA) and the American Academy of Pediatrics (AAP) maintain that gender-affirming care is evidence-based and medically necessary.
"This bill is the most extreme anti-transgender legislation to ever pass through the House," said Rep. Mark Takano (D-Ca.), Chair of the Congressional Equality Caucus. "It places the threat of prosecution between families and their doctors."
Critics also pointed out a perceived inconsistency in the legislation: while the bills ban care for transgender youth, they explicitly allow non-consensual surgeries on intersex infants, a practice that advocates say causes genuine, documented harm.
While these bills face a difficult path in the Senate, where Democrats hold a slim majority and are expected to "hold the line," the House's action sets the stage for a major legal and political showdown in 2026. Civil rights groups, including the ACLU, have already announced plans to challenge the constitutionality of these measures should they move closer to becoming law.
Meanwhile 46 Virginia LGBTQIA+ organizations headed up by Equality Virginia signed a this joint letter in support of gender-affirming care in V.irginia:
As Virginians, we stand unequivocally for the right of transgender people and their families to access medically appropriate, evidence-based health care—free from fear, stigma, or political intrusion. Decisions about health care belong where they always have: between patients, families, and qualified medical professionals, guided by compassion, expertise, and respect—not ideology.
Gender-affirming care is health care. It is supported by decades of medical research and endorsed by leading medical and professional organizations. It is lifesaving. Efforts to restrict this care—through intimidation, defunding, or government mandates—put politics ahead of people and inflict real harm on families striving to support their loved ones.
We reject attempts to single out transgender people, especially transgender youth, by inserting government control into deeply personal family decisions. These attacks undermine privacy, erode trust in medical providers, and replace care with fear. No family should be forced to justify their child’s medical needs to politicians who neither know them nor understand their lives.
Virginians believe in personal freedom, privacy, and the right to make decisions for ourselves and our families. We trust parents to act in the best interests of their children. We trust doctors to provide ethical, appropriate care. And we believe government’s role is to safeguard these freedoms—not take them away.
What we are witnessing is part of a broader, coordinated effort nationwide to roll back protections for transgender people and impose rigid, one-size-fits-all policies that ignore medical science and lived experience. These attacks come at a time when families are already navigating rising health care costs and uncertainty—yet some political leaders choose to target a vulnerable community instead of addressing real challenges.
To families of transgender youth in Virginia: you are not alone. You deserve respect, privacy, and the freedom to make informed health care decisions with providers you trust. Our Commonwealth stands with you.
To transgender Virginians of all ages: you belong here. You deserve safety, dignity, and access to the care you need to live full, healthy lives.
Together, we are committed to protecting and expanding access to gender-affirming care and ensuring Virginia remains a place where freedom is meaningful, privacy is respected, and every person is treated with dignity.
